Agreement to Terms
By accessing or using the services provided by WLY Wesley Chapel Concrete, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, customers, and others who access or use our concrete services.
Services Description
WLY Wesley Chapel Concrete provides professional concrete installation, repair, and maintenance services for residential and commercial properties. Our services include but are not limited to driveways, patios, foundations, decorative concrete, repairs, and specialized concrete work. All services are subject to availability and will be provided in accordance with industry standards and local building codes.
Estimates and Pricing
We provide written estimates for all projects based on site assessments and customer requirements. Estimates are valid for 30 days from the date of issue unless otherwise specified. Final pricing may vary from initial estimates if project scope changes or unforeseen site conditions require additional work. Any changes to project scope or pricing will be communicated and approved in writing before work proceeds.
Payment Terms
Payment terms will be specified in your service agreement. Typically, we require a deposit before work begins, with the balance due upon project completion. We accept cash, checks, and major credit cards. Customers are responsible for payment regardless of third-party financing arrangements. Late payments may be subject to additional fees as permitted by law.
Project Timeline and Delays
We provide estimated project timelines based on normal working conditions. Actual completion dates may be affected by weather, material availability, permit delays, or other circumstances beyond our control. We will communicate any delays promptly and work to minimize project disruptions. Time is not of the essence unless specifically stated in writing in your service agreement.
Customer Responsibilities
Customers are responsible for providing accurate property information, securing necessary permits when required, ensuring site access for equipment and materials, and maintaining clear work areas. You must disclose any known site conditions that might affect the project, including underground utilities, easements, or property restrictions. Failure to provide accurate information may result in additional costs or project delays.
Warranties and Guarantees
We warrant that all work will be performed in a professional manner using quality materials. Specific warranty terms for materials and workmanship will be provided in your service agreement. Warranties do not cover damage caused by improper use, lack of maintenance, ground settling, acts of nature, or modifications made by others. Any warranty claims must be reported promptly in writing.
Limitation of Liability
To the fullest extent permitted by law, WLY Wesley Chapel Concrete liability is limited to the amount paid for services. We are not liable for indirect, incidental, special, or consequential damages arising from our services. This limitation applies regardless of the legal theory upon which any claim is based. Some jurisdictions do not allow limitations on certain damages, so these limitations may not apply to you.
Property Access and Site Conditions
You grant us permission to access your property during agreed-upon working hours. We will make reasonable efforts to protect landscaping, structures, and property during work, but are not responsible for damage to unmarked underground utilities, hidden obstacles, or pre-existing conditions not disclosed prior to work commencing. You are responsible for relocating vehicles, outdoor furniture, and other items from work areas.
Changes and Cancellations
Either party may request changes to the project scope. All changes must be agreed upon in writing before work proceeds. Cancellation policies will be specified in your service agreement. Generally, deposits are non-refundable once materials are ordered or work has begun. Cancellations after work has commenced may result in charges for work completed and materials purchased.
Permits and Regulations
We will advise you regarding permit requirements for your project. Permit applications and fees are typically the customer responsibility unless otherwise specified in your service agreement. We will perform all work in accordance with applicable building codes and regulations. Customers are responsible for compliance with homeowner association rules and private covenant restrictions.
Dispute Resolution
Any disputes arising from these terms or our services will first be addressed through good faith negotiation. If negotiation fails, disputes may be resolved through mediation before pursuing litigation. Any legal proceedings will be conducted in the appropriate courts of Florida. The prevailing party in any dispute may be entitled to recover reasonable attorney fees and costs.
Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms. Material changes will be communicated to existing customers with active service agreements.
